Terms of Service

The terms that apply when you use texasnewhomerewards.com.

1. Accepting these terms

These Terms of Service ("Terms") govern your use of texasnewhomerewards.com (the "Site"). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. About us

Texas New Home Rewards ("Texas New Home Rewards," "we," "us" or "our") is a new-construction home buyer program and a subsidiary of Pipeline Concierge. Real estate brokerage services are provided by Ken Michael, a Texas licensed real estate sales agent (License #571164) sponsored by eXp Realty, LLC (License #603392).

3. Using the Site is not representation

Browsing the Site, using the reward calculator or the home search, or submitting a form does not create a broker and client relationship or any agency relationship. Representation begins only when you and the broker sign a written buyer representation agreement, as Texas law requires. The Texas Real Estate Commission Information About Brokerage Services notice, linked at the bottom of every page, explains the ways a license holder can represent you.

4. Our programs

New construction reward

  • The reward is up to 2.5% and is not guaranteed. It equals 2.5% of the final commissionable purchase price or, if less, the builder-paid brokerage compensation actually received minus 0.5% of the purchase price.
  • Eligibility generally requires a signed buyer representation agreement before you visit or register with a builder. If you visited or registered with a builder before enrolling, you qualify only if that builder recognizes and compensates the brokerage.

Pre-owned home credit

  • The credit is up to 2% and is not guaranteed. It equals 2% of the purchase price or, if less, the buyer's agent compensation actually received minus 1% of the purchase price.

Listing program

  • Homes are listed for a 1% listing fee. Any compensation offered to a buyer's agent, and third-party costs, are separate and disclosed in writing. Commissions are negotiable and not set by law.

Terms that apply to every program

  • Rewards and credits depend on compensation actually received and are disclosed in the transaction and on the closing statement. They are subject to lender approval, loan program limits, title and closing requirements, eXp Realty policy and Texas Real Estate Commission rules.
  • The reward calculator gives estimates only. An estimate is not an offer, a commitment or a guarantee.
  • These program terms apply, and we may modify or discontinue any program at any time. Changes do not affect a reward, credit or fee already agreed in writing for a pending transaction.

5. Listings and property information

Homes, communities, pricing, incentives and availability shown on the Site come from builders and third parties, including ShowingNew. This information changes often and may be incomplete, out of date or inaccurate. School districts, property tax rates, PID and MUD status, HOA fees and similar details should be verified independently before you rely on them. We do not guarantee that any home is available at any price.

6. No legal, tax or financial advice

Content on the Site is general information, not legal, tax, accounting or financial advice. We are not a lender, and nothing on the Site is a loan offer or a commitment to lend. Please consult your own attorney, tax professional or lender about your situation.

7. Communications and text messages

When you give us your phone number and agree to be contacted, you consent to receive calls and text messages from Texas New Home Rewards about your home search, appointments, eligibility and the reward program, including messages sent using automated technology.

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any message to opt out. You may receive one final message confirming you have been unsubscribed.
  • Reply HELP for help, or email robert.ken.michael@gmail.com.
  • Consent to receive text messages is not a condition of buying a home or of working with us.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • You confirm that the phone number you provide is yours, or that you are authorized to use it, and that you will tell us if it changes.

8. Third-party services and links

The Site includes services and links provided by others, such as the ShowingNew home search and links to Pipeline Concierge, eXp Realty and the Texas Real Estate Commission. Those services have their own terms and privacy policies, and we are not responsible for their content, availability or practices.

9. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • submit false information, or information about someone else without their permission;
  • copy, scrape or collect content or data from the Site using automated means;
  • interfere with the Site's operation or security, or try to gain unauthorized access to it; or
  • use the Site to send spam or other unsolicited messages.

10. Intellectual property

The Site and its content, including text, design, graphics and the Texas New Home Rewards name, are owned by us or our licensors and are protected by law. You may view and print pages for your personal, non-commercial use. The eXp Realty name and logo, the ShowingNew name, and other names and logos on the Site are the trademarks of their respective owners.

11. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, about the Site or its content, including warranties of accuracy, availability, merchantability or fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, Texas New Home Rewards, Pipeline Concierge and their owners, agents and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site, and our total liability relating to the Site will not exceed one hundred dollars ($100).

Nothing in these Terms limits any obligation under a signed buyer representation agreement, or any right you have under Texas law that cannot be waived.

13. Indemnity

You agree to indemnify and hold harmless Texas New Home Rewards and Pipeline Concierge from claims arising from your misuse of the Site or your violation of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute relating to the Site will be resolved in the state or federal courts located in Texas.

15. Fair housing

We are committed to equal housing opportunity and comply with all federal, state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin or any other characteristic protected by law.

16. Changes to these terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continuing to use the Site after an update means you accept the revised Terms.
